各省、自(zi)治區、直轄市人民(min)政府,國務院各部委、各直屬機構:
  全(quan)民(min)所(suo)(suo)有自(zi)然(ran)(ran)資(zi)源是憲法(fa)和(he)法(fa)律(lv)規定屬(shu)于(yu)國(guo)(guo)(guo)家所(suo)(suo)有的各類(lei)自(zi)然(ran)(ran)資(zi)源,主要(yao)包括國(guo)(guo)(guo)有土地資(zi)源、水資(zi)源、礦產(chan)資(zi)源、國(guo)(guo)(guo)有森林資(zi)源、國(guo)(guo)(guo)有草(cao)原(yuan)資(zi)源、海域海島資(zi)源等(deng)。自(zi)然(ran)(ran)資(zi)源資(zi)產(chan)有償(chang)使用制(zhi)(zhi)(zhi)度(du)是生態文明制(zhi)(zhi)(zhi)度(du)體(ti)(ti)系的一(yi)項(xiang)核心制(zhi)(zhi)(zhi)度(du)。改革(ge)開放(fang)以(yi)來,我國(guo)(guo)(guo)全(quan)民(min)所(suo)(suo)有自(zi)然(ran)(ran)資(zi)源資(zi)產(chan)有償(chang)使用制(zhi)(zhi)(zhi)度(du)逐步建立,在促進自(zi)然(ran)(ran)資(zi)源保護和(he)合理(li)利(li)用、維(wei)護所(suo)(suo)有者權(quan)(quan)(quan)益方面發揮了(le)積極作(zuo)用,但由于(yu)有償(chang)使用制(zhi)(zhi)(zhi)度(du)不(bu)完善、監管力(li)度(du)不(bu)足,還存(cun)在市場配置(zhi)資(zi)源的決定性作(zuo)用發揮不(bu)充分、所(suo)(suo)有權(quan)(quan)(quan)人不(bu)到位、所(suo)(suo)有權(quan)(quan)(quan)人權(quan)(quan)(quan)益不(bu)落實(shi)等(deng)突出(chu)問題。按(an)照生態文明體(ti)(ti)制(zhi)(zhi)(zhi)改革(ge)總(zong)體(ti)(ti)部署(shu),為(wei)健(jian)全(quan)完善全(quan)民(min)所(suo)(suo)有自(zi)然(ran)(ran)資(zi)源資(zi)產(chan)有償(chang)使用制(zhi)(zhi)(zhi)度(du),現提出(chu)以(yi)下意見。
  一、總體(ti)要求
  (一)指導思想(xiang)。全(quan)面貫徹(che)黨(dang)的十(shi)八大和(he)(he)(he)(he)十(shi)八屆三中(zhong)、四(si)中(zhong)、五中(zhong)、六中(zhong)全(quan)會(hui)精神,深入(ru)貫徹(che)習近平總(zong)書記系列(lie)重(zhong)要(yao)講話(hua)精神和(he)(he)(he)(he)治(zhi)國(guo)理政(zheng)新(xin)理念(nian)新(xin)思想(xiang)新(xin)戰略(lve),認真落(luo)實(shi)黨(dang)中(zhong)央、國(guo)務院決策部(bu)署,統籌推(tui)進“五位一體”總(zong)體布(bu)局和(he)(he)(he)(he)協(xie)調(diao)推(tui)進“四(si)個全(quan)面”戰略(lve)布(bu)局,牢(lao)固樹立(li)和(he)(he)(he)(he)貫徹(che)落(luo)實(shi)創(chuang)新(xin)、協(xie)調(diao)、綠色、開(kai)放、共享的發展理念(nian),堅持發揮市場配置(zhi)資源的決定性作用(yong)(yong)和(he)(he)(he)(he)更好發揮政(zheng)府作用(yong)(yong),以(yi)保(bao)(bao)護優先(xian)、合(he)理利(li)用(yong)(yong)、維護權(quan)益和(he)(he)(he)(he)解(jie)決問題為導向,以(yi)依法管理、用(yong)(yong)途管制為前(qian)提(ti)(ti),以(yi)明晰(xi)產(chan)權(quan)、豐(feng)富權(quan)能為基(ji)礎,以(yi)市場配置(zhi)、完善(shan)規則為重(zhong)點(dian),以(yi)開(kai)展試點(dian)、健全(quan)法制為路徑,以(yi)創(chuang)新(xin)方式、加強監管為保(bao)(bao)障,加快建立(li)健全(quan)全(quan)民(min)所(suo)有(you)(you)自(zi)然(ran)(ran)資源資產(chan)有(you)(you)償使(shi)用(yong)(yong)制度,努力提(ti)(ti)升自(zi)然(ran)(ran)資源保(bao)(bao)護和(he)(he)(he)(he)合(he)理利(li)用(yong)(yong)水平,切實(shi)維護國(guo)家所(suo)有(you)(you)者權(quan)益,為建設(she)美麗中(zhong)國(guo)提(ti)(ti)供重(zhong)要(yao)制度保(bao)(bao)障。
  (二)基本原則。
  保(bao)(bao)護(hu)(hu)優先、合理(li)(li)(li)利(li)(li)用(yong)(yong)。樹(shu)立尊(zun)重自(zi)然(ran)(ran)(ran)、順應(ying)自(zi)然(ran)(ran)(ran)、保(bao)(bao)護(hu)(hu)自(zi)然(ran)(ran)(ran)的(de)(de)(de)(de)理(li)(li)(li)念,堅持(chi)保(bao)(bao)護(hu)(hu)和(he)發(fa)(fa)(fa)(fa)展相統一,在發(fa)(fa)(fa)(fa)展中(zhong)保(bao)(bao)護(hu)(hu)、在保(bao)(bao)護(hu)(hu)中(zhong)發(fa)(fa)(fa)(fa)展。正確處(chu)理(li)(li)(li)資(zi)(zi)源(yuan)(yuan)保(bao)(bao)護(hu)(hu)與(yu)開發(fa)(fa)(fa)(fa)利(li)(li)用(yong)(yong)的(de)(de)(de)(de)關系,對需要嚴格(ge)保(bao)(bao)護(hu)(hu)的(de)(de)(de)(de)自(zi)然(ran)(ran)(ran)資(zi)(zi)源(yuan)(yuan),嚴禁(jin)開發(fa)(fa)(fa)(fa)利(li)(li)用(yong)(yong);對可開發(fa)(fa)(fa)(fa)利(li)(li)用(yong)(yong)的(de)(de)(de)(de)全民所有自(zi)然(ran)(ran)(ran)資(zi)(zi)源(yuan)(yuan),使(shi)用(yong)(yong)者要遵守用(yong)(yong)途管(guan)制(zhi),履(lv)行保(bao)(bao)護(hu)(hu)和(he)合理(li)(li)(li)利(li)(li)用(yong)(yong)自(zi)然(ran)(ran)(ran)資(zi)(zi)源(yuan)(yuan)的(de)(de)(de)(de)法定義務。除國家法律和(he)政策規定可劃撥或(huo)無償使(shi)用(yong)(yong)的(de)(de)(de)(de)情形外,全面實(shi)(shi)行有償使(shi)用(yong)(yong),切(qie)實(shi)(shi)增強使(shi)用(yong)(yong)者合理(li)(li)(li)利(li)(li)用(yong)(yong)和(he)有效保(bao)(bao)護(hu)(hu)自(zi)然(ran)(ran)(ran)資(zi)(zi)源(yuan)(yuan)的(de)(de)(de)(de)意識(shi)和(he)內在動力。
  兩(liang)權(quan)(quan)分離、擴權(quan)(quan)賦能。適應經濟社會(hui)發展多元化需(xu)求和(he)自(zi)然資源(yuan)資產多用途屬(shu)性(xing),在堅持全(quan)民所(suo)(suo)(suo)有(you)制的(de)前提下,創新全(quan)民所(suo)(suo)(suo)有(you)自(zi)然資源(yuan)資產所(suo)(suo)(suo)有(you)權(quan)(quan)實(shi)現形(xing)式,推動所(suo)(suo)(suo)有(you)權(quan)(quan)和(he)使用權(quan)(quan)分離,完善全(quan)民所(suo)(suo)(suo)有(you)自(zi)然資源(yuan)資產使用權(quan)(quan)體系,豐富自(zi)然資源(yuan)資產使用權(quan)(quan)權(quan)(quan)利(li)類型,適度擴大使用權(quan)(quan)的(de)出(chu)讓(rang)、轉讓(rang)、出(chu)租(zu)、擔保、入股等(deng)權(quan)(quan)能,夯實(shi)全(quan)民所(suo)(suo)(suo)有(you)自(zi)然資源(yuan)資產有(you)償使用的(de)權(quan)(quan)利(li)基礎。
  市(shi)(shi)場配(pei)置、完善(shan)規則。充分(fen)發揮市(shi)(shi)場配(pei)置資源(yuan)的決定(ding)性(xing)作用(yong)(yong),按照公開(kai)(kai)、公平(ping)、公正(zheng)和(he)(he)競爭擇優的要求(qiu),明確(que)全(quan)(quan)(quan)民所(suo)有(you)(you)自(zi)然資源(yuan)資產(chan)有(you)(you)償(chang)(chang)使(shi)用(yong)(yong)準入(ru)條件(jian)、方(fang)式和(he)(he)程序,鼓勵競爭性(xing)出讓,規范協議出讓,支持探索多樣化有(you)(you)償(chang)(chang)使(shi)用(yong)(yong)方(fang)式,推動將全(quan)(quan)(quan)民所(suo)有(you)(you)自(zi)然資源(yuan)資產(chan)有(you)(you)償(chang)(chang)使(shi)用(yong)(yong)逐(zhu)步(bu)納入(ru)統一的公共資源(yuan)交易平(ping)臺,完善(shan)全(quan)(quan)(quan)民所(suo)有(you)(you)自(zi)然資源(yuan)資產(chan)價格評估方(fang)法和(he)(he)管理制度,構建完善(shan)價格形成機制,建立(li)健全(quan)(quan)(quan)有(you)(you)償(chang)(chang)使(shi)用(yong)(yong)信(xin)息(xi)公開(kai)(kai)和(he)(he)服務制度,確(que)保國家所(suo)有(you)(you)者權益得到充分(fen)有(you)(you)效維護。
  明確權責、分級行使。全民(min)所(suo)有(you)自然(ran)資(zi)(zi)源(yuan)資(zi)(zi)產(chan)有(you)償(chang)使用試點(dian)可依(yi)照現行法律規定和管理(li)體制,明確全民(min)所(suo)有(you)自然(ran)資(zi)(zi)源(yuan)資(zi)(zi)產(chan)有(you)償(chang)處置的主體,在試點(dian)地區(qu)可結合(he)實際,合(he)理(li)劃分中央和地方政(zheng)府(fu)對全民(min)所(suo)有(you)自然(ran)資(zi)(zi)源(yuan)資(zi)(zi)產(chan)的處置權限,創新管理(li)體制,明確和落實主體責任,實現效率和公平(ping)相統一。
  創新方(fang)式(shi)、強化監管(guan)(guan)。建立健全(quan)(quan)市場主體信用評價制度,強化自(zi)然(ran)資(zi)源(yuan)主管(guan)(guan)部門(men)和財(cai)政等(deng)部門(men)協同,發(fa)揮(hui)紀(ji)檢(jian)監察(cha)、司法、審計等(deng)機(ji)構作用,完善(shan)國家自(zi)然(ran)資(zi)源(yuan)資(zi)產(chan)管(guan)(guan)理體制和自(zi)然(ran)資(zi)源(yuan)監管(guan)(guan)體制,創新管(guan)(guan)理方(fang)式(shi)方(fang)法,健全(quan)(quan)完善(shan)責(ze)任追(zhui)究(jiu)機(ji)制,實(shi)(shi)現對全(quan)(quan)民所有(you)(you)(you)(you)自(zi)然(ran)資(zi)源(yuan)資(zi)產(chan)有(you)(you)(you)(you)償使用全(quan)(quan)程動態有(you)(you)(you)(you)效監管(guan)(guan),確保(bao)將有(you)(you)(you)(you)效保(bao)護(hu)和合(he)理利(li)用資(zi)源(yuan)、維護(hu)國家所有(you)(you)(you)(you)者(zhe)權益的各項(xiang)要求落到實(shi)(shi)處。
  (三)主要目(mu)標(biao)。到2020年,基本建立產權明晰、權能豐富、規則完善、監管有(you)效、權益(yi)落實(shi)的(de)全民(min)所(suo)有(you)自然資源資產有(you)償使用(yong)(yong)(yong)(yong)制度(du),使全民(min)所(suo)有(you)自然資源資產使用(yong)(yong)(yong)(yong)權體(ti)系更加完善,市(shi)場配(pei)置資源的(de)決定性作用(yong)(yong)(yong)(yong)和政府的(de)服務監管作用(yong)(yong)(yong)(yong)充分發揮,所(suo)有(you)者和使用(yong)(yong)(yong)(yong)者權益(yi)得到切實(shi)維護,自然資源保護和合理利用(yong)(yong)(yong)(yong)水平顯著(zhu)提升,實(shi)現自然資源開發利用(yong)(yong)(yong)(yong)和保護的(de)生態、經(jing)濟、社會效益(yi)相統(tong)一。
  二、各領域重(zhong)點任務(wu)
  (四)完善(shan)(shan)國(guo)有(you)(you)(you)(you)(you)(you)土(tu)(tu)(tu)地(di)(di)資(zi)源(yuan)有(you)(you)(you)(you)(you)(you)償(chang)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)制(zhi)度(du)(du)。全面(mian)落實規(gui)劃土(tu)(tu)(tu)地(di)(di)功(gong)能(neng)分區和(he)保(bao)護(hu)利(li)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)的(de)要求,優化土(tu)(tu)(tu)地(di)(di)利(li)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)布局,規(gui)范(fan)經(jing)營性土(tu)(tu)(tu)地(di)(di)有(you)(you)(you)(you)(you)(you)償(chang)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)。對生態功(gong)能(neng)重要的(de)國(guo)有(you)(you)(you)(you)(you)(you)土(tu)(tu)(tu)地(di)(di),要堅持保(bao)護(hu)優先,其(qi)中(zhong)依照法(fa)律規(gui)定和(he)規(gui)劃允(yun)許進行(xing)經(jing)營性開發利(li)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)的(de),應(ying)設立(li)更加(jia)嚴格(ge)的(de)審批條件和(he)程(cheng)序,并(bing)全面(mian)實行(xing)有(you)(you)(you)(you)(you)(you)償(chang)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong),切實防止無償(chang)或過(guo)度(du)(du)占用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)。完善(shan)(shan)國(guo)有(you)(you)(you)(you)(you)(you)建(jian)設用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)有(you)(you)(you)(you)(you)(you)償(chang)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)制(zhi)度(du)(du)。擴大國(guo)有(you)(you)(you)(you)(you)(you)建(jian)設用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)有(you)(you)(you)(you)(you)(you)償(chang)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)范(fan)圍,加(jia)快修訂《劃撥(bo)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)目(mu)錄》。完善(shan)(shan)國(guo)有(you)(you)(you)(you)(you)(you)建(jian)設用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)權(quan)(quan)權(quan)(quan)能(neng)和(he)有(you)(you)(you)(you)(you)(you)償(chang)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)方(fang)式。鼓(gu)勵(li)可(ke)以使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)劃撥(bo)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)的(de)公共服(fu)務項目(mu)有(you)(you)(you)(you)(you)(you)償(chang)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)國(guo)有(you)(you)(you)(you)(you)(you)建(jian)設用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)。事業單位等改制(zhi)為企(qi)業的(de),允(yun)許實行(xing)國(guo)有(you)(you)(you)(you)(you)(you)企(qi)業改制(zhi)土(tu)(tu)(tu)地(di)(di)資(zi)產處置政策。探索建(jian)立(li)國(guo)有(you)(you)(you)(you)(you)(you)農(nong)(nong)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)有(you)(you)(you)(you)(you)(you)償(chang)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)制(zhi)度(du)(du)。明(ming)晰國(guo)有(you)(you)(you)(you)(you)(you)農(nong)(nong)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)權(quan)(quan),明(ming)確國(guo)有(you)(you)(you)(you)(you)(you)農(nong)(nong)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)的(de)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)方(fang)式、供應(ying)方(fang)式、范(fan)圍、期限、條件和(he)程(cheng)序。對國(guo)有(you)(you)(you)(you)(you)(you)農(nong)(nong)場、林場(區)、牧場改革中(zhong)涉及的(de)國(guo)有(you)(you)(you)(you)(you)(you)農(nong)(nong)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di),參照國(guo)有(you)(you)(you)(you)(you)(you)企(qi)業改制(zhi)土(tu)(tu)(tu)地(di)(di)資(zi)產處置相關規(gui)定,采取(qu)國(guo)有(you)(you)(you)(you)(you)(you)農(nong)(nong)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)權(quan)(quan)出讓、租(zu)賃、作價出資(zi)(入(ru)股)、劃撥(bo)、授權(quan)(quan)經(jing)營等方(fang)式處置。通過(guo)有(you)(you)(you)(you)(you)(you)償(chang)方(fang)式取(qu)得的(de)國(guo)有(you)(you)(you)(you)(you)(you)建(jian)設用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)、農(nong)(nong)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)地(di)(di)使(shi)(shi)用(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)(yong)權(quan)(quan),可(ke)以轉讓、出租(zu)、作價出資(zi)(入(ru)股)、擔(dan)保(bao)等。

  (七)建(jian)立國(guo)(guo)有(you)森(sen)(sen)(sen)林(lin)(lin)(lin)(lin)(lin)資(zi)(zi)源(yuan)(yuan)有(you)償(chang)使用(yong)(yong)制度。嚴格(ge)執行森(sen)(sen)(sen)林(lin)(lin)(lin)(lin)(lin)資(zi)(zi)源(yuan)(yuan)保(bao)護(hu)(hu)政策,充分發(fa)揮森(sen)(sen)(sen)林(lin)(lin)(lin)(lin)(lin)資(zi)(zi)源(yuan)(yuan)在生態建(jian)設中的(de)(de)(de)主體(ti)作用(yong)(yong)。國(guo)(guo)有(you)天然林(lin)(lin)(lin)(lin)(lin)和(he)公益(yi)林(lin)(lin)(lin)(lin)(lin)、國(guo)(guo)家公園、自(zi)然保(bao)護(hu)(hu)區(qu)(qu)、風(feng)景(jing)名勝(sheng)區(qu)(qu)、森(sen)(sen)(sen)林(lin)(lin)(lin)(lin)(lin)公園、國(guo)(guo)家濕地公園、國(guo)(guo)家沙(sha)漠公園的(de)(de)(de)國(guo)(guo)有(you)林(lin)(lin)(lin)(lin)(lin)地和(he)林(lin)(lin)(lin)(lin)(lin)木資(zi)(zi)源(yuan)(yuan)資(zi)(zi)產(chan)不得(de)出讓。對確(que)需經(jing)營(ying)利用(yong)(yong)的(de)(de)(de)森(sen)(sen)(sen)林(lin)(lin)(lin)(lin)(lin)資(zi)(zi)源(yuan)(yuan)資(zi)(zi)產(chan),確(que)定有(you)償(chang)使用(yong)(yong)的(de)(de)(de)范圍、期限、條件、程序和(he)方式(shi)。對國(guo)(guo)有(you)森(sen)(sen)(sen)林(lin)(lin)(lin)(lin)(lin)經(jing)營(ying)單位的(de)(de)(de)國(guo)(guo)有(you)林(lin)(lin)(lin)(lin)(lin)地使用(yong)(yong)權(quan),原則上按照劃(hua)撥用(yong)(yong)地方式(shi)管理。研究制定國(guo)(guo)有(you)林(lin)(lin)(lin)(lin)(lin)區(qu)(qu)、林(lin)(lin)(lin)(lin)(lin)場改(gai)革涉及的(de)(de)(de)國(guo)(guo)有(you)林(lin)(lin)(lin)(lin)(lin)地使用(yong)(yong)權(quan)有(you)償(chang)使用(yong)(yong)的(de)(de)(de)具體(ti)辦法。推進國(guo)(guo)有(you)林(lin)(lin)(lin)(lin)(lin)地使用(yong)(yong)權(quan)確(que)權(quan)登(deng)記工作,切實(shi)維護(hu)(hu)國(guo)(guo)有(you)林(lin)(lin)(lin)(lin)(lin)區(qu)(qu)、國(guo)(guo)有(you)林(lin)(lin)(lin)(lin)(lin)場確(que)權(quan)登(deng)記頒證(zheng)成果的(de)(de)(de)權(quan)威性(xing)(xing)和(he)合法性(xing)(xing)。通過租賃、特許(xu)經(jing)營(ying)等方式(shi)積極(ji)發(fa)展森(sen)(sen)(sen)林(lin)(lin)(lin)(lin)(lin)旅游。本著尊(zun)重歷史(shi)、照顧現(xian)實(shi)的(de)(de)(de)原則,全面清理規范已經(jing)發(fa)生的(de)(de)(de)國(guo)(guo)有(you)森(sen)(sen)(sen)林(lin)(lin)(lin)(lin)(lin)資(zi)(zi)源(yuan)(yuan)流轉行為。
  (八)建立國(guo)(guo)(guo)有(you)(you)(you)草原(yuan)(yuan)資(zi)源有(you)(you)(you)償使(shi)(shi)(shi)(shi)用(yong)(yong)(yong)制(zhi)(zhi)度。依法(fa)依規嚴格保(bao)護(hu)草原(yuan)(yuan)生態(tai),健全(quan)基本草原(yuan)(yuan)保(bao)護(hu)制(zhi)(zhi)度,任(ren)何單(dan)位(wei)和個人(ren)不得擅自征用(yong)(yong)(yong)、占用(yong)(yong)(yong)基本草原(yuan)(yuan)或改變其用(yong)(yong)(yong)途,嚴控建設占用(yong)(yong)(yong)和非牧使(shi)(shi)(shi)(shi)用(yong)(yong)(yong)。全(quan)民所有(you)(you)(you)制(zhi)(zhi)單(dan)位(wei)改制(zhi)(zhi)涉(she)及(ji)的國(guo)(guo)(guo)有(you)(you)(you)劃撥草原(yuan)(yuan)使(shi)(shi)(shi)(shi)用(yong)(yong)(yong)權(quan)(quan),按照(zhao)國(guo)(guo)(guo)有(you)(you)(you)農用(yong)(yong)(yong)地改革政(zheng)策實行有(you)(you)(you)償使(shi)(shi)(shi)(shi)用(yong)(yong)(yong)。穩定(ding)和完(wan)善國(guo)(guo)(guo)有(you)(you)(you)草原(yuan)(yuan)承包(bao)(bao)經營(ying)制(zhi)(zhi)度,規范國(guo)(guo)(guo)有(you)(you)(you)草原(yuan)(yuan)承包(bao)(bao)經營(ying)權(quan)(quan)流(liu)(liu)轉。對已確定(ding)給農村(cun)集體經濟組織(zhi)使(shi)(shi)(shi)(shi)用(yong)(yong)(yong)的國(guo)(guo)(guo)有(you)(you)(you)草原(yuan)(yuan),繼續依照(zhao)現有(you)(you)(you)土(tu)地承包(bao)(bao)經營(ying)方式(shi)落實國(guo)(guo)(guo)有(you)(you)(you)草原(yuan)(yuan)承包(bao)(bao)經營(ying)權(quan)(quan)。國(guo)(guo)(guo)有(you)(you)(you)草原(yuan)(yuan)承包(bao)(bao)經營(ying)權(quan)(quan)向(xiang)農村(cun)集體經濟組織(zhi)以外單(dan)位(wei)和個人(ren)流(liu)(liu)轉的,應按有(you)(you)(you)關規定(ding)實行有(you)(you)(you)償使(shi)(shi)(shi)(shi)用(yong)(yong)(yong)。加(jia)快推進(jin)國(guo)(guo)(guo)有(you)(you)(you)草原(yuan)(yuan)確權(quan)(quan)登記(ji)頒證工作。

  三、加(jia)大改革統籌協調和組織實施力度
  (十)加強(qiang)與(yu)相關(guan)改(gai)(gai)(gai)革(ge)的銜接(jie)協(xie)調。推進全民所有(you)自(zi)然(ran)資(zi)(zi)(zi)(zi)源資(zi)(zi)(zi)(zi)產有(you)償使用制(zhi)(zhi)(zhi)度(du)(du)(du)改(gai)(gai)(gai)革(ge),要(yao)切(qie)實(shi)加強(qiang)與(yu)自(zi)然(ran)資(zi)(zi)(zi)(zi)源產權(quan)制(zhi)(zhi)(zhi)度(du)(du)(du)、自(zi)然(ran)資(zi)(zi)(zi)(zi)源統一(yi)確權(quan)登(deng)記制(zhi)(zhi)(zhi)度(du)(du)(du)、國土空間用途管(guan)制(zhi)(zhi)(zhi)制(zhi)(zhi)(zhi)度(du)(du)(du)、空間規劃體系、自(zi)然(ran)資(zi)(zi)(zi)(zi)源管(guan)理體制(zhi)(zhi)(zhi)、資(zi)(zi)(zi)(zi)源稅費制(zhi)(zhi)(zhi)度(du)(du)(du)、生態(tai)保護(hu)補償制(zhi)(zhi)(zhi)度(du)(du)(du)、創新政府(fu)配(pei)置資(zi)(zi)(zi)(zi)源方式、統一(yi)的公共資(zi)(zi)(zi)(zi)源交(jiao)易平臺(tai)建設、政府(fu)資(zi)(zi)(zi)(zi)產報告制(zhi)(zhi)(zhi)度(du)(du)(du)等(deng)相關(guan)改(gai)(gai)(gai)革(ge)的銜接(jie)協(xie)調,增強(qiang)改(gai)(gai)(gai)革(ge)的系統性、整體性和(he)協(xie)同性。
  (十一)系統(tong)部(bu)署改革試(shi)(shi)(shi)點(dian)(dian)。穩(wen)妥推進(jin)礦業(ye)權(quan)出讓制度等各(ge)相(xiang)關改革試(shi)(shi)(shi)點(dian)(dian)。試(shi)(shi)(shi)點(dian)(dian)重點(dian)(dian)在國(guo)(guo)家生態文(wen)明試(shi)(shi)(shi)驗區、健全(quan)國(guo)(guo)家自然資源(yuan)資產管理體制試(shi)(shi)(shi)點(dian)(dian)地(di)區和其他(ta)具(ju)備條件的地(di)區進(jin)行,其中(zhong)確需突破現(xian)行法律、行政(zheng)法規、國(guo)(guo)務(wu)院文(wen)件和國(guo)(guo)務(wu)院批準的部(bu)門規章的,要按程序報(bao)批,取得(de)授權(quan)后實施。各(ge)相(xiang)關部(bu)門要加強指導,做好總結評(ping)估,發現(xian)問題及時糾偏(pian)。
  (十二(er))統籌推(tui)進法(fa)(fa)治(zhi)建設。立足生態文(wen)明(ming)體(ti)制(zhi)(zhi)改革全(quan)局,以完(wan)(wan)善全(quan)民(min)所(suo)有(you)自(zi)然(ran)資(zi)源(yuan)資(zi)產使用(yong)權體(ti)系(xi)和有(you)償(chang)使用(yong)制(zhi)(zhi)度為(wei)重點,推(tui)進完(wan)(wan)善土(tu)地(di)、水、礦產、森林、草原、海域、無居(ju)民(min)海島等(deng)全(quan)民(min)所(suo)有(you)自(zi)然(ran)資(zi)源(yuan)資(zi)產有(you)償(chang)使用(yong)的(de)法(fa)(fa)律(lv)(lv)法(fa)(fa)規體(ti)系(xi)。開展對(dui)(dui)全(quan)民(min)所(suo)有(you)自(zi)然(ran)資(zi)源(yuan)資(zi)產有(you)償(chang)使用(yong)不規范(fan)行為(wei)的(de)清理排查。對(dui)(dui)于法(fa)(fa)律(lv)(lv)制(zhi)(zhi)度完(wan)(wan)善的(de),要及時糾正不規范(fan)行為(wei)和違法(fa)(fa)行為(wei)。對(dui)(dui)于法(fa)(fa)律(lv)(lv)存在缺位或(huo)不完(wan)(wan)善的(de),各(ge)地(di)區、各(ge)部門要在發現(xian)問(wen)題、總結經驗的(de)基礎上,按(an)程序推(tui)動(dong)相關法(fa)(fa)律(lv)(lv)法(fa)(fa)規立改廢釋。
  (十三)協同開展資(zi)產(chan)清(qing)查(cha)核(he)算(suan)。以各類自(zi)(zi)然(ran)(ran)資(zi)源調查(cha)評(ping)價和(he)(he)(he)統計監測為(wei)基礎,推(tui)進全(quan)民所(suo)(suo)有(you)自(zi)(zi)然(ran)(ran)資(zi)源資(zi)產(chan)清(qing)查(cha)核(he)算(suan),研究完善相(xiang)關指標(biao)體系、標(biao)準(zhun)(zhun)規(gui)范(fan)和(he)(he)(he)技術規(gui)程,做(zuo)好與自(zi)(zi)然(ran)(ran)資(zi)源資(zi)產(chan)負債(zhai)表編(bian)制工作的銜接,建立全(quan)民所(suo)(suo)有(you)自(zi)(zi)然(ran)(ran)資(zi)源資(zi)產(chan)目錄清(qing)單、臺賬和(he)(he)(he)動態更(geng)新機制,全(quan)面(mian)、準(zhun)(zhun)確、及時掌握我國(guo)全(quan)民所(suo)(suo)有(you)自(zi)(zi)然(ran)(ran)資(zi)源資(zi)產(chan)“家底”,為(wei)全(quan)面(mian)推(tui)進有(you)償(chang)使用和(he)(he)(he)監管提供依(yi)據。
  (十四(si))強(qiang)(qiang)化組織實(shi)(shi)施。各(ge)地區、各(ge)部(bu)門要(yao)高度(du)(du)重(zhong)(zhong)視,充分(fen)(fen)認識全民所有(you)(you)自然資(zi)源資(zi)產(chan)(chan)有(you)(you)償使用制(zhi)度(du)(du)改(gai)革(ge)對于生態(tai)文(wen)明(ming)建設的(de)重(zhong)(zhong)要(yao)意義,切實(shi)(shi)加強(qiang)(qiang)組織領(ling)導(dao)和細化落(luo)實(shi)(shi),按(an)照黨中央(yang)、國(guo)(guo)務(wu)院(yuan)關于生態(tai)文(wen)明(ming)體(ti)(ti)(ti)制(zhi)改(gai)革(ge)總體(ti)(ti)(ti)部(bu)署和本(ben)意見要(yao)求(qiu),抓(zhua)緊(jin)研(yan)究(jiu)(jiu)制(zhi)定具體(ti)(ti)(ti)實(shi)(shi)施方(fang)案。地方(fang)各(ge)級政府要(yao)結合實(shi)(shi)際,加強(qiang)(qiang)研(yan)究(jiu)(jiu)和探索,為深化全民所有(you)(you)自然資(zi)源資(zi)產(chan)(chan)有(you)(you)償使用制(zhi)度(du)(du)改(gai)革(ge)提供(gong)實(shi)(shi)踐支撐。各(ge)有(you)(you)關部(bu)門要(yao)按(an)照職責分(fen)(fen)工(gong),各(ge)司(si)其職,密切配合,明(ming)確(que)責任主體(ti)(ti)(ti)和時(shi)間進(jin)度(du)(du),加強(qiang)(qiang)協調指(zhi)導(dao),確(que)保各(ge)具體(ti)(ti)(ti)領(ling)域(yu)改(gai)革(ge)任務(wu)落(luo)到實(shi)(shi)處(chu)。國(guo)(guo)土資(zi)源部(bu)要(yao)牽頭建立(li)部(bu)際協調機制(zhi),加強(qiang)(qiang)對全民所有(you)(you)自然資(zi)源資(zi)產(chan)(chan)有(you)(you)償使用制(zhi)度(du)(du)改(gai)革(ge)工(gong)作(zuo)的(de)統籌指(zhi)導(dao)和督(du)促落(luo)實(shi)(shi),及(ji)時(shi)研(yan)究(jiu)(jiu)改(gai)革(ge)中出現的(de)新情(qing)況(kuang)、新問(wen)題,重(zhong)(zhong)大問(wen)題和工(gong)作(zuo)進(jin)展情(qing)況(kuang)及(ji)時(shi)向國(guo)(guo)務(wu)院(yuan)報告。
